Our team of Public and Administrative law has a broad experience in all fields of public and administrative law. It deals with the most important matters concerning public procurements and the financing of public projects, public-private partnerships, public utilities, in particular in the sectors of telecommunications, water, waste management, transports (including airports) and energy.
CMS DeBacker takes actively part in the process of liberalisation of public services by assisting its clients through the drafting of laws and regulations (including for the implementation of European directives), the creation of new public or private actors, or their reorganisation. It has an in-depth knowledge of the public authorities’ interventions in the economy: competition, State aids, public holdings, inter-municipal entities, economic expansion laws, public service concessions, management agreements, exclusive and special rights, Eurostat criteria, etc. It has a solid experience in town planning and environment as well as carbon credit regulations (especially in brown fields) and allocation, waste regulations, etc.
The team deals with litigation issues before the regulators and the European Commission and jurisdictions or the Belgian Competition Council and other national jurisdictions.
